In Europe security services have been sending thousands of Silent SMS messages, allowing them to locate and track smart phones without the recipient's knowledge.
I also have a smart phone, real fine one by Android. And I think that a legal vacuum exists around the technique.
The Silent sms uses an invisible return signal, or ping. Developers from the Silent Services company, who created some of the first software for sending this type of sms, explain:
The Silent sma allows the user to send a message to another mobile without the knowledge of the recipient mobile’s owner. The message is rejected by the recipient mobile, and leaves no trace. In return, the sender gets a message from a mobile operator confirming that the Silent sms has been received.
About various German police authorities having used nearly half a million (sent more than 440,000) silent sms to track suspects in 2010.
Requesting such network logs was a legal gray area until 2007, when Germany amended its telecommunications surveillance act.
Now we are can only wonder, just how many other countries consider this type of tracking to be a gray are?
